GUEST INDEMNITY, ASSUMPTION OF RISK & PROPERTY RULES FORM

Please complete and sign this form before arrival. Each adult guest must read and acknowledge the relevant terms. The person making the booking must ensure that all members of their group, including children, are informed of the property rules and relevant risks.

ACKNOWLEDGEMENT OF THE NATURAL ENVIRONMENT

I acknowledge that Seldom Seen is situated in a natural bushveld environment. The property may contain uneven ground, rocks, steep or slippery areas, steps, insects, snakes, wild animals and other natural hazards. Weather conditions, darkness and reduced visibility may increase these risks.

I understand that wild animals are unpredictable and may be dangerous. I agree to follow all safety instructions, remain in designated areas where instructed, keep a safe distance from wildlife, and never feed, approach, touch or provoke wild animals.

I understand that outdoor activities and movement around the property involve inherent risks, including slips, falls, bites, stings, injury and, in certain circumstances, serious injury or death.

MOUNTAIN DRIVE AND BRAAI

I understand that the mountain drive is conducted in a 4×4 vehicle driven by an authorised Seldom Seen staff member. The drive takes place in a natural environment and may involve uneven terrain, steep inclines or declines, loose surfaces, dust, sudden vehicle movement and changing weather conditions.

I agree to follow all instructions given by the driver, remain seated while the vehicle is moving, use the seat belt provided, and keep my hands, arms and other body parts inside the vehicle while it is in motion.

I will not distract the driver, interfere with the vehicle's controls or attempt to enter or exit the vehicle until instructed that it is safe to do so.

I understand that participation in the mountain drive involves inherent risks, including the possibility of injury. I acknowledge these risks and voluntarily choose to participate, subject to the rights and protections afforded to me by South African law.

I understand that Seldom Seen may postpone, change or cancel the drive if conditions are considered unsafe.

CHILDREN AND SUPERVISION

I accept responsibility for ensuring that children in my group are appropriately supervised by a responsible adult at all times, particularly around wildlife, roads, vehicles, braai fires, swimming or water areas, steps, elevated areas and other potential hazards.

I will explain the property rules and relevant safety risks to the children in my care and ensure that they follow all instructions.

I understand that signing this form on behalf of a child does not automatically remove or waive any legal rights the child may have under South African law.

FIRE, BRAAI AND GENERAL SAFETY

I agree to use braai facilities, fires, appliances and equipment responsibly and only in designated areas. Fires must never be left unattended. I will comply with any fire restrictions, instructions or warnings issued by the property or its staff.

I will not tamper with safety equipment, enter restricted areas, climb structures or trees, or undertake any activity that could endanger myself, other guests, staff or the property.

I agree to notify the host or management promptly of any hazard, damage, injury or incident.

SWIMMING POOL SAFETY

I understand that Seldom Seen has a swimming pool and that swimming and being near water carry inherent risks, including slipping, falling, injury, drowning and other serious harm.

I acknowledge that I am responsible for assessing my own swimming ability and for acting responsibly around the pool.

I agree to the following rules:

• Children must be actively supervised by a responsible adult at all times in and around the pool. Children must never be left unattended near the water, even if they can swim.

• Guests swim at their own risk, subject to Seldom Seen's legal responsibilities and any applicable safety requirements.

• No running, pushing, rough play or dangerous behaviour is permitted around the pool.

• Guests must not swim under the influence of alcohol or any substance that impairs judgement, coordination or swimming ability.

• Guests must follow all pool safety notices and instructions issued by Seldom Seen staff.

• Any unsafe condition, damage or incident involving the pool must be reported to management immediately.

I understand that a swimming pool can present a serious risk even when it appears calm or shallow. I agree to take reasonable precautions and to ensure that children in my care understand and follow these rules.

PERSONAL BELONGINGS AND PROPERTY DAMAGE

I understand that I am responsible for my personal belongings and should take reasonable precautions to keep them secure.

I agree to take reasonable care of the accommodation, furniture, equipment and facilities provided. I may be held responsible, in accordance with applicable law, for loss or damage caused by my intentional or negligent conduct or that of members of my group, subject to proof and applicable legal requirements.

Nothing in this section excludes any liability that cannot lawfully be excluded.

ASSUMPTION OF INHERENT RISKS

I confirm that I have read and understood the risks described in this form and have had a reasonable opportunity to ask questions before signing.

I voluntarily accept the inherent risks associated with staying in a natural bushveld environment and participating in activities that I choose to undertake, provided that this acceptance is limited to the extent permitted by South African law.

I understand that the risks may include personal injury, illness, damage to personal property and, in exceptional circumstances, serious injury or death.

LIMITATION OF LIABILITY AND INDEMNITY

To the extent permitted by South African law, I accept responsibility for the consequences of risks that I knowingly and voluntarily assume and agree to be responsible for loss or damage caused by my own unlawful, intentional or negligent conduct, including conduct for which I am legally responsible.

Nothing in this form is intended to exclude or limit liability where such exclusion or limitation is prohibited by law, including applicable consumer protection legislation, or to remove any non-waivable legal rights.

No term in this form is intended to excuse fraud, unlawful conduct or liability that cannot lawfully be excluded.

COMPLIANCE WITH PROPERTY RULES

I agree that all guests in my booking will comply with the property rules and safety instructions provided by Seldom Seen and its authorised representatives.

I understand that serious or repeated breaches of safety rules may result in an activity being stopped or access to a particular area being restricted. Any further action relating to a guest’s stay will be handled in accordance with the booking terms and applicable law.

EMERGENCY ASSISTANCE

In the event of an emergency, I authorise Seldom Seen’s representatives to contact emergency services or the emergency contact listed above where reasonably necessary.

I understand that emergency assistance may be affected by the property’s rural location, weather conditions or mobile network coverage.

DECLARATION AND SIGNATURE

I confirm that I am at least 18 years old, that the information supplied is accurate to the best of my knowledge, and that I have read and understood this form.

I have had the opportunity to ask questions and understand that this document contains important information about risks and responsibility during my stay.
